Businessman Convicted of Stealing Sh750,000 from DTB
A Nairobi court has convicted a businessman who was charged with stealing Sh 750,000 from Diamond Trust Bank.
Douglas Mutati Kithuku who committed the offence in 2018 was convicted by the Milimani Senior Principal Magistrate Dolphina Alego after five years of trial in court.
Mutati was charged with stealing contrary to section 268(1) as read with section 275 of the constitution and handling of stolen goods contrary to section 322 (2) of the penal code.
The prosecution presented the charges that on June 6, 2018, jointly with others who were not in court, stole Sh 750,000 the property of Victoria Commercial Bank Limited.
The offence took place at Diamond Trust Bank, Industrial Area Branch within Nairobi county.
He was further charged that on the same dates at Diamond Trust Bank Industrial Area Branch in Nairobi within Nairobi county otherwise in the course of stealing, knowingly and dishonestly handled Sh 750,000 in his bank account bearing the name Douglas Mutati Kithuku knowing or having reasons to believe it to be stolen or unlawfully obtained.
When he was arraigned in court, he denied the charges and was released on bond.
After almost five years in trial, the court found Mutati to have a case to answer and was put in defence.
In his defence, Mutati did not deny withdrawing money from the said bank but disagreed with the amount,
“I agree withdrawing Sh 450,000 from Diamond Trust Bank but not Sh 750,000 as the charges indicate,” Mutati defended himself.
In the judgement which was delivered yesterday in Milimani magistrate court, he was convicted of the offence of stealing,
“I have convicted you with the offence of stealing hence cancelling your bond and you will remain in custody awaiting for the sentence” said the magistrate.
The court further ordered the Investigating officer to avail the pre-bail report on August 1, 2024, when the convict will mitigate and the sentence delivered.
