A reveller was on Tuesday charged at a Milimani law court for stealing two bottles of wine valued at Sh 88,000.
Lilian Makena Muenda appeared before the Milimani senior principal magistrate Benmark Ekhumbi and denied the charges against her.
The prosecution told the court that on April 28, 2024, at Two Rivers Mall within Westlands sub-county within Nairobi county Jointly with others who were not before the court stole two bottles of Hennessy Xo valued at Sh 88,000.
The said wine was the property of Two Rivers Liquor Shop.
The prosecution further told the court that, the alleged offence that Makena was charged with is in the public domain since the perpetrators were captured by the CCTV cameras in that shop where the footages were forwarded to the DCI Gigiri Police Station,
“Your honor I want to put this court aware that the matter before court is in public domain since the accused was captured by the CCTV camera in the complainant shop,” said the state prosecutor.
In pleading for leniency, Makena told the court that she had been sickly and admitted to the hospital where she was discharged on May 2, 2023, four days after the alleged offence took place,
“Your honor I had been sick and was admitted in a medical facility in Kasarani since April 23, and discharged on May 2, 2024 despite being a mother of little kids who rely on me,” she told the court.
Makena denied the charges claiming on the material day when the offence took place she was still admitted to hospital.
The young woman was identified as being among those who were captured by the CCTV cameras within the complainant’s shop last month.
She presented medical documents before the court which were doubted leading the magistrate to call for a probation report before determining her fate.
The magistrate ordered her to deposit a cash bail of Sh 50,000 awaiting the probation report on Thursday.
