A city lawyer is rooting for the committal to jail the Inspector General of police for disobeying a court order to produce in court a suspect Peter Korir who was allegedly abducted by police three weeks ago.
The application which was filed before a Kibera High Court by lawyer Dr. Ham Lagat based on the ground that Korir has been illegally held in custody since being arrested on May 5, 2024, by the agents or representatives of the Inspector General.
Lagat says that Korir has been tortured and subjected to inhumane treatment at the hands of police and he has not been charged with any offence since being arrested.
In his application certified as urgent dated May 9, 2024, the lawyer stated that police are torturing him to provide unknown information and confess to crimes he does not know about.
He pleaded with the court to issue orders that Korir be produced before the court within 24 hours and for the said court to determine his fate regarding the bond terms.
Mr Korir has been denied a chance to see or talk to his relatives while detained without any reasonable excuse for the continued detention.
Other respondents included in the suit are the Director of Criminal Investigations and Director of Public prosecutions.
In determining the matter which was held virtually on May 13, 2024, Justice Diana Kavedza gave a ruling ordering the respondents to produce Korir in court on or before May 15, 2024, at Kibera Chief Magistrate’s Court.
The judge also ordered the respondents to explain why the said Paul Korir should not be released on bond,
“Upon his production, the DPP will be at liberty to present any charge against him in any court in which the orders of this court will lapse,” said Justice Kavedza.
Despite the release orders by the court which was served to the respondents that Korir be produced in court on the said date, the Inspector General of police, his representatives, or agents has declined to obey the court order and produce him in court.
