Company Manager Associated With Government PS Charged With Stealing
A manager of a company associated with a cabinet secretary has been charged with stealing animal health products worth Sh67million.
Mr Hussein Ismail Godad of Garissa County was arraigned before Milimani senior principal magistrate Bernard Ochoi.
Godad, a Wharehouse manager at Medina Chemical Limited, denied the charge filed against him by the prosecution led by a state lawyer James Gachoka of stealing by servant.
The accused was accused of stealing the animal health products on January 17, 2024 at the premises of Medina Chemical Limited wharehouse within Nairobi.
The magistrate heard Mr Godad stole assorted animal health products valued at Sh67,513,761, the property of Medina Chemicals Limited.
The accused allegedly accessed the products by virtue of his employment.
He applied to be freed on bond saying he is not a flight risk and that will abide with the terms and conditions that will be imposed on him by the court.
State prosecutor James Gachoka did not oppose the accused being released on bond.
“I have no instructions to oppose the release of the accused person on bond,” Mr Gachoka told the magistrate.
He added that police have concluded investigations into the case and that bond or cash bail is a constitutional right of any suspect.
In a brief ruling Mr Ochoi said the prosecution is not opposed to the release of the accused on bond.
He added that bond is constitutional right to any suspect and that it can only be denied if compelling reasons are presented.
“Having considered the submissions of both the accused and prosection I hereby direct that the accused do deposit a bond of Sh10million with an alternative cash bail of Sh5million,” Mr Ochoi ruled.
He also ordered the prosecution to furnish the accused with witness statements to enable him prepare his defence.
Mr Ochoi fixed the case to be mentioned on February 28 ,2024 for pre-trial directions
