Detained: The Cyber Harassment Saga of Samuel Brian Yongo Otumba

A businessman Samuel Brian Yongo Otumba has been detained for five days for allegedly cyber harassment claims.

Yongo was detained at Parklands police station for five days.

Milimani senior principal magistrate Dolphina Alego directed police to record a statement from the complainant Rajendra Shanghani who is the managing director of Granada Trading Company Limited.

The state prosecutor Sonia Njoki told the magistrate that police are investigating a computer misuse and cyber harassment crime against Yongo.

Njoki said that a report was filed at Parklands Police Station by Shanghani claiming that he had been harassed and threatened by Yongo.

The magistrate heard that Yongo, called Shanghani via WhatsApp regarding a case against John Malongo of Subru Mortors who had been charged before the Kibera Law Court. 

The court heard that Yongo informed Shanghani that they were planning to tarnish his name after he was appointed by Malongo to look into his accounts and deal with the matter accordingly.

Shanghani claims that during their conversations they fell out with Yongo after he requested to meet him on a Friday night something he declined alleging the suspect hearing had begun issuing threats.

Shanghani reported to the Parklands Police that Yongo kept calling him through WhatsApp claiming that he had been appointed by Manojkumar, his brother to pursue him over allegations relating to their family property and money.

Shanghani claims Yongo kept on calling and abusing him using unprintable words.

The suspect allegedly swore using his mother’s name that Shanghani would know who he was,

“Yongo continued abusing Shanghani swearing in his mother’s name and saying that he would teach him a lesson,” said the investigating officer in the court.

He prayed to detain him for seven days to enable him to carry out a cyber analysis at DCI Headquarters forensic laboratory for extraction.

He also said he needs to record a statement from Manojkumar which is yet to be recorded.

The officer said that they require more than 24 hours to complete the investigation.

He also stated he needs to record a statement from John Malongo of Subru Mortors.

Yongo opposed the application to detain him for seven days saying he was unwell and required urgent medical attention,

“Your honor I kindly plead with this court to grant me a personal bond since I have health challenge and I have already suffered for two days,” he pleaded.

He also told the magistrate to release him on bond and be ordered to report to the DCI officer daily and insisted on complying.

In her ruling, the magistrate said police needed to be given ample time to complete investigations then directed Yongo to be detained for five days.
