The owner of City Gas Limited who was charged with illegal refilling of LPG gas cylinders of other brands without permission from brand owners has been released on Sh 5 million bond.
Adan Hassan was charged in 2021 and denied the charges presented before him and the matter was determined, thereafter an order of re-arresting him was issued by the high court.
The charges read that on April 16, 2021, at City Gas Limited LPG storage and filling facility located off Lunga Lunga Road in the Industrial Area within Nairobi county jointly with others not before court found to have filled assorted brands of LPG gas cylinders without authority from brand owners to fill.
Adan later changed his plea and pleaded guilty to the charges where the statement of the offense was presented before the court by the prosecution and the court proceeded with sentencing him.
After the sentence, the complainant who is Petroleum Institute of East Africa was not satisfied by the sentence delivered and went to the high court for the review and revision of the sentence.
On July 25, 2022, the high court ordered the re-arresting of the convict where he was required to pay a fine of Sh 10 million or serve 5 years imprisonment.
Adan was arrested on January 26, this year following a warrant by the high court for sentencing.
He was presented before the court on January 29, this year and the court gave him some time following the miscellaneous application revision in the high court.
He was arraigned yesterday following the oral application seeking for plea that he did not participate in the revision determined in the high court either personally or by his advocate.
He pleaded with the court pending the hearing and determination of the miscellaneous application in the high court to be released on bond.
Through his lawyer Julius Anyoka, he convinced the court to consider him a family man with 16 children and six under his care,
“My client is the director of the company also a family man with children and he is not a flight risk hence pleading his release on bond,” said Anyoka.
Giving the directions on the matter, the Milimani senior principal magistrate Esther Kimilu cited that, though the court has not been served with the miscellaneous application by the high court, the court has considered that the accused has the right to bear fair trial and be listened to,
“Although the court has not been served with the miscellaneous application, the accused person has the right to face fair trial and be listened as cited by the constitution,” said the magistrate.
Mrs. Kimilu released him on a Sh 5 million bond with two sureties of the same amount or alternative cash bail of Sh 2 million with two contact persons.
The matter was scheduled for mentioned on April 25, 2024, waiting for the determination by the high court.
