Land of Deception: The Case of False Titles and Forgeries

A businessman had been charged at a Nairobi court with obtaining land registration illegally besides a series of forgeries aiming to occupy land amounting to Sh 420 million illegally.

Amos Mutinda Kilonzo was charged that on January 29, 2019, at Athi house in Nairobi within Nairobi county jointly with others not in court with intent to defraud obtained a land registration LR 20145 IR NO 108894 measuring 4.993 hectares by falsely pretending he had obtained the title genuinely from the Ministry of Lands a false fact.

The said parcel of land is the property of Hebron Properties Limited.

At an unknown place and dates within the republic of Kenya jointly with others not in court with intent to defraud, Mutinda forged a grant in the name of Hebron Properties Limited purporting it to be a genuine and valid grant a fact he knew was false.

The court also heard that the accused went on to forge a deed plan NO 230490 and certificate of incorporation NO 11034 in the name of Hebron Properties Limited and purported them to be genuine documents issued by the Director of Survey and Registrar of Companies a false fact.

The prosecution further told the court that on July 14, 2020, at the DCI office at Athi River within Machakos county knowingly and fraudulently Mutinda uttered a forged deed plan NO 230490 dated June 8, 2000, to police constable Peter Mbembi.

He appeared before the Milimani chief magistrate Lucas Onyina and denied the charges.

The defence lawyer sought leniency in granting bond terms citing that his client would abide by the rules which will be set by the court,

“Your honor I request my client be released on lenient bond terms assuring this court that my client will abide with the rules which the court will set,” he pleaded.

He was released on a cash bail of Sh 200,000 with one contact person.

The matter will be mentioned on April 10, 2024, for pre-trial and directions.
