Makadara Court Orders Arrest of Fleeing Kware Killing Suspect

A Makadara court has issued a warrant of arrest to Kware killing the main suspect Collins Jumaisi whilst releasing the other two suspects on a personal bond of Sh 50,000 each.

Coprol Pascal Bwana who is attached to DCI Headquarters Homicide Division Unit appeared before the Makadara principal magistrate Irene Gichobi for the mention of the matter which was scheduled on Monday.

The three suspects Collins Jumaisi, Amos Momanyi and Moses Ogembo appeared in the same court on August 16, 2024, when the officer was given a nod to hold them for seven more days to conclude their investigations.

Bwana confirmed to the court that the first suspect Collins Jumaisi escaped from Gigiri Police Station on August 20, 2024, where he was detained and is yet to be apprehended,

“Your honor I am confirming to this court that the first suspect in this matter Collins Jumaisi had escaped from police custody where he was detained and is yet to be arrested,” Bwana told the court.

The officer also told the court that they are still on their toes to arrest the suspect who is still at large.

He confirmed to the court the progress they have made over the last seven days saying they forwarded the duplicate files to the Office of Director of Public Prosecution for further directions.

He told the court that they received a response letter from the ODPP dated August 26, 2024, directing them to appear in court and pray the two remaining suspects be released on bond,

“Your honor we have directions from the ODPP directing is the two remaining suspects be released on bond,” he told the court.

The officer also told the magistrate that the two suspects would probably become the state witnesses whereas the first suspect who is at large would be charged with murder.

The ODPP further requested the court to give orders that Amos Momanyi and Moses Ogembo report to the DCI Headquarters Homicide Division once every two weeks and the warrant of arrest to Collins Jumaisi be issued.

In their final plea, they requested the matter be mentioned in a month to give the Investigating officers time to pursue Collins and bring him to court.

The defence lawyer for Collins Jumaisi John Maina Ndegwa who appeared in court in the absence of his client and while addressing the court, said he waited for the court’s directions,

“Your honor I appear for the first suspect who is absent in court since I am still on record,” Ndegwa said.

Sichangi Nyongesa for Momanyi and Ogembo was enticed by the letter from the ODPP praying for their release on bond,

“Your honor I appreciate the decision by the prosecution that my clients be released on bond,” Nyongesa said.

He prayed for lenient terms citing that they had been in custody for more than a month and assured the court that he would be ensuring their appearance to the investigators whenever required.

The lawyer further pleaded with the court to give orders for the release of the 118 phones and other items from Ogembo claiming they are not part of their Investigations.

In response, the officer told the court that the said phones were still under analysis and prayed for two weeks to complete the task.

In his ruling, the magistrate noted the letter from the prosecution praying the court to release the two suspects on bond and other orders sought,

“I have noted the prayers by the prosecution to release the two suspects on bond and issuing a warrant of arrest to the first suspect.

She released the two suspects on a personal bond of Sh 50,000 with two contact persons each.

She further ordered them to report to the DCI Headquarters once every two weeks.

The matter will be mentioned on September 26, 2024, for further directions.
