Augustine Musume Juma pleaded guilty to the two counts of personation and having government stores before Milimani chief magistrate Susan Shitubi.
The court heard that the accused was arrested on January 16, 2024, in the Ngara area within Nairobi county by falsely presenting himself as a police officer.
He also faced another charge of being in possession of police handcuffs, the property of National Police Service – Administration police service property suspected to have been stolen.
The prosecution told the court that on the day of arrest, Musume approached Solomon Wachira, a watchman at a Muslim academy in Nairobi, by presenting himself as a police officer and arrested him.
He handcuffed Wachira, and both boarded a motorcycle pretending to take him to Kangemi Police Station, which he assumed to be his working station.
On their way to Kangemi in the Ngara area, they were accosted by two police officers, Inspector Ibrahim Adan and Corporal Philip Suntu.
On questioning, Musume purported to be a police officer, Dennis Rufuta, but the officers suspected him not to be a police officer.
He provided an identity card of the administration police certificate of appointment bearing the name of Dennis Rufuta.
He was arrested and taken to Ngara Police Station.
In Mitigation, he pleaded with the court for forgiveness, citing that he is very remorseful and first-time offender,
“Your honor I ask this court for mercy and release me to go and take care of my young family,” he pleaded.
He also said he is a father of three, one aged four months, and the sole breadwinner.
In passing the sentence, Shitubi cited that the matter was severe, posing as a police officer and arresting,
“You will serve three years in jail without a fine for each of the two counts both running concurrently,” said the magistrate.
