Police Probe Cleared Four Officers, Two Civilians Face Sh 2.2 Million Theft Charges
Four police officers who were under probe over Sh 2.2 million theft at Mihang’o in Nairobi have been released leaving their two accomplices facing charges of stealing.
Sergeant Antony Ndegwa, Coprol Daniel Lekakeny, and Constable Antony Mwendwa are DCI officers from Kasarani while Constable Simon Macharia is a police officer from Ruai Police Station who were arrested together with two civilians Young Wakhisi and Lucas Magoiga Chacha.
They were arrested on June 6, 2024, at Kasarani Police Station public parking by a team of DCI officers from the Nairobi Area and Kayole.
The four were released after the conclusion of the Investigation led by police Inspector Dominic Omondi against the six while Wakhisi and Magoiga were charged with the offence of stealing.
Wakhisi and Magoiga were charged that on June 3, 2024, at the Mihang’o area in Njiru sub-county within Nairobi county jointly with others not before the court stole Sh 2,200,000 the property of Rophine Junior School Limited.
The prosecution told the court that to commit such theft, the two opened a locked motor vehicle KCE 535 L Toyota Axio where the money was kept.
The court heard that Victor Peter Owino who is an accountant at Rophine International School made a withdrawal of Sh 2,361,000 at Family Bank Utawala branch on June 3, 2024, which was meant to pay casual workers.
After the withdrawal of the money, Owino proceeded to the school which is located within Mihang’o while driving a motor Vehicle registration number KCE 535L Toyota Axio parked outside the school compound and went inside the school with Sh 161,000 leaving the rest of the money in the car which he locked safely,
“Minutes later, Omondi went for the remaining Sh 2,200,000 but found it missing in the car.”
He went on to Mihang’o Police Station and reported the matter.
On retrieval of the school CCTV cameras, footage showed that a motor vehicle registration number KCR 595D saloon, silver in colour with three occupants who were seen alighting and gaining access into Omondi’s car and made away with the brown envelope believed to be containing the money.
They appeared before the Milimani chief magistrate Bernard Ochoi and denied the charges.
Defence lawyers pleaded with the court for their release on lenient bond terms since it is their constitutional right,
“Your honor I urge this court to release the two on lenient terms considering they are young men with young families and they are sole bread winners,” pleaded the defence.
The lawyer further indicated that their places of abode are known and they are willing to abide by the rules which will be set by the court.
The prosecution did not oppose their release on bond but requested the court to put terms commensurate with the amount stolen,
“Your honor I do not oppose their release on bond but I will urge this court to give terms equal measure to the amount stolen,” said state prosecutor Herbert Sonye.
In his ruling, the magistrate ordered the accused persons to deposit a bond of Sh 800,000 with a surety of the same amount or alternative cash bail of Sh 300,000 with one contact person each.
The matter will be mentioned on June 27, 2024, for further directions.
