A Somali national suspected to have tried to kill a private personal security guard will remain in custody for 14 days pending the conclusion of the investigation.
Mohammed Yasin Ali was arrested on April 19, 2024, on suspicion of attempting murder contrary to section 202 (a) of the penal code.
Police Constable Sammy Shamalla who is the lead investigator in the matter sought to detain the suspect for 14 days to conclude the investigation before charging the suspect.
Through his affidavit, Mr Shamalla told the Milimani senior principal magistrate Dolphina Alego that on that material day, Ali was in the company of his friend Abduselan Mohammed Dahir who had hired the complainant privately for security purposes when he was stabbed by the suspect.
The court heard that the complainant had met the suspect in other several occasions in the company of his client in other clubs who was fond of causing chaos and breach of peace prompting the clubs to ban the respondent from accessing most of the clubs.
Dahir via phone called the complainant instructing him to go to a club along Gong Road where he met him (Dahir) with Ali and a group of five other men and jointly they proceeded to Nairobi Street Kitchen in the Westlands area.
When they were subjected to a security check-up by the club security, they spotted Mr Ali and denied him access to the club since he had caused chaos earlier in the same club.
“He became violent and demanded entry by force but the security requested the complainant to take him out, this prompted Dahir to take him out whom he fought leading to the loss of spectacles,” said the officer.
When the complainant saw Dahir involved in a scuffle, he whisked him into the club leaving Ali throwing a barrage of curses to a certain point he told the complainant he would kill him and later he pretended to leave the club.
When the complainant was passing through the security checkpoint he was stabbed on the neck from behind, and Ali was seen holding the knife in his hand attempting to stab him the second time but before managing he was wrestled on the ground by the people around security.
Due to the loss of much blood, the complainant fell and he was rescued and taken to Mp Shah hospital and admitted.
The suspect tried to flee the scene but he was overpowered and almost subjected to mob injustice luckily he was rescued and taken to Parklands Police Station,
“The knife was recovered which was used by the suspect and blood stained clothes from both the complainant and respondent are yet to be taken to Government laboratory for DNA extermination,” said Shamalla.
Preliminary investigation by the officers disclosed that the suspect snatched the knife from a hawker by the roadside, ran after the complainant maliciously, and with intent to kill stabbing him in the neck from behind.
The complainant is still admitted to the hospital unable to talk and yet register the statement to give the accounts of what transpired,
“Since he is unable to talk we pray for more time waiting the complainant to recuperate and record his statement,” he pleaded.
The officer also said that they are yet to receive the medical report from the hospital a vital element to be relied on during preferring charges against the suspect.
The officer further convinced the court that the suspect was a foreigner from Somalia hence a flight risk if released on bail.
He reiterated to the court that despite the suspect depositing his passport in court he can still escape since Somalia is accessible by road.
In her ruling, the magistrate considered the prayers sought by the officer and ordered the respondent to be detained at Parklands Police Station for 14 days,
“I have considered the application by the officer considering that the suspect is a foreigner and the nature of the offence, grant the period sought by the investigating officer,” said the Magistrate.
The matter was scheduled for mention on May 9, 2024, for further directions.
