Two Dentists Await September Hearing on Negligence and Grievous Harm Charges

Two doctors who were charged with negligence and causing grievous harm to the patient will wait until September this year when hearing of their case will commence.

Sunil Vinayak and Geoffrey Muiruri King’ang’a, dentists from Eurodent Center Hospital are out on a cash bail of Sh 100,000 and will wait until September when the hearing of the matter will commence.

In adjourning the matter, the Milimani senior principal magistrate Dolphina Alego considered the prayers of the counsel representing Sunil Vinayak who prayed that he will be travelling tomorrow out of the country for one month hence urging him to push on the hearing date,

“Your honor we are here to allocate the hearing date whereby before then I want to inform the court that I will be out of the country for one month from tomorrow,” said the lawyer.

The duo were faced with two counts of housing grievous harm contrary to section 234 of the penal code and reckless and negligent acts contrary to section 243 of the penal code.

They were charged that on August 26,  2015, at Eurodent Center Hospital in the Westlands area within Nairobi county unlawfully did grievous harm to Michael Isaac Ochieng during a dental medical procedure.

They were further charged that on the said day and area, in a manner so negligent as to endanger human life, being a dentist, gave to Michael Isaac  Ochieng whom you had undertaken to treat, a dental procedure that endangered his life.

They denied the charges and were released on a cash bail of Sh 100,000.

The matter was scheduled for hearing on September 3 and 4, 2024.
