Proprietor of Nelrach Investment in Court Over Ksh 600,000 Bad Cheque

Through her lawyer, she pleaded with the court to release her on lenient terms.

A proprietor of Nelrach Investment has been charged in a Nairobi court with the offence of issuing a bad cheque in the amount of Ksh 600,000.

On March 18, 2022, at Eco Bank Towers in Nairobi, within Nairobi County, Mary Gathoni Ndung’u issued a cheque number 83 for Ksh 600,000 in favor of Mwananchi Credit Limited, held at KCB Bank Kenya Limited in the name of Nelrach Investments, despite being aware that the account had insufficient funds.

In the second count, she was charged with disposition of mortgaged goods contrary to Section 291 of the Penal Code.

The prosecution told the court that at an unknown day and place, Gathoni, being a mortgager of motor vehicle registration number KBS 956T with intent to defraud, disposed of the said mortgaged goods without the consent of Mwananchi Credit Limited, the mortgagee.

She denied the charges before the Milimani senior principal magistrate Benmark Ekhubi.

Through her lawyer, she pleaded with the court to release her on lenient terms,

“Your honor I pray this court to release the accused person on lenient bond terms considering is the woman of small means,” he pleaded.

She was released on a bond of Ksh 250,000 with a surety of a similar amount or alternative cash bail of Ksh 65,000 with one contact person.

The matter will be mentioned on August 5, 2025.
