Heritage Flowers Director’s Threat to Kill Case Adjourned to November
"Your Honour, I am the new counsel on record, and I have not familiarised myself with the file; hence I pray for an adjournment," the lawyer submitted.
The Nairobi court has adjourned the criminal case in which a director of Heritage Flowers Limited is charged with threatening to kill a co-director to give the defence counsel time to peruse the file.
While admitting the application by the defence lawyer, Milimani Principal Magistrate Caroline Mugo gave the matter two days in November to hear and conclude the matter.
The application came after the accused changed advocate and wanted time to peruse the file.
“Your Honour, I am the new counsel on record, and I have not familiarised myself with the file; hence I pray for an adjournment,” the lawyer submitted.
The prosecution did not oppose the application for adjournment; they informed the court that two witnesses were boarded and they were ready to proceed.
“Your Honour, we do not oppose the application for adjournment, although we were ready to proceed with two witnesses,” stated prosecution Irene Magolo to the Magistrate.
The court admitted the defence’s application to adjourn the matter, and the Magistrate had scheduled the hearing date on November 26 and 20, 2026.
The 2023 matter has been delayed to a point where the Director of Public Prosecutions (DPP once applied for withdrawal, as the court ceased considering the seriousness of the offence.
The accused, Shailesh Kumar Rai, was charged with threatening to kill Punjani Riyaz Mahammadali, a co-director in the company.
Rai is alleged to have committed the offence on 27th May 2022 at Parklands, Nairobi, without lawful excuse.
