Court Declines to Drop Peter Salasya’s Hate Speech Case Over Breach of Agreement

"I concur with the application by the DPP to withdraw the matter but I suspend the withdrawal for 14 days awaiting compliance," the Magistrate ruled.

Milimani Magistrate’s Court has suspended the withdrawal of the hate speech case against Mumias East MP Peter Salasya for failure to comply with the agreement signed between him and the National Cohesion and Integration Commission NCIC.
While declining the application, Milimani Principal Magistrate Paul Mutai stated that after perusing the agreement, he noted that before the withdrawal of the matter, the MP must have launched a Social Media peace campaign and produced evidence in court.
The Magistrate also noted that Salasya agreed to do a media briefing communicating to the public on the same issues that he has not fulfilled.
“After the perusal of the agreement produced, I have noted that no evidence was produced before me showing compliance as per the agreement,” the Magistrate stated.
The court directed to concur with the application by the DPP to withdraw the matter, but suspended until the MP complies.

The DP, thro, ugh, the State counsel Nora Achieng had applied for the withdrawal of the, matter saying there was an agreement between the accused and  NCIC to solve the matter out of court.
The Magistrate admitted the application but declined to withdraw the matter until Salasya complies with the agreement he signed. The court further ordered the the evidence to be produced in court after compliance.
On his part, the MP embraced the application by the DPP and assured the court he would comply fully as per the agreement.
The matter will be mentioned on February 2, 2026, to confirm compliance.
