Ex-PC Chelogoi’s Sh1.5B Fraud Case Judgment Temporarily Stopped by High Court
"Owing to the history and urgency of the matter, the court shall deliver the ruling on October 15, 2026."
The High Court has stayed the delivery of a judgment in a Ksh 1.5 billion fraud case involving former Nairobi Provincial Commissioner (PC) Davis Nathan Chelogoi and an Official staff member in the Ministry of Lands.
Justice Alexander Muteti stayed the lower court proceedings to deliver the judgment that was set to be delivered today to conclude the court battles between the former PC and a senior officer in the Ministry of Lands, Andrew Aseli Kirungu, Ashok Rupshi Shah and Hitenkumar Amitral Raja.
The 2023 matter has been delayed by the defence following myriad applications in the High Court seeking various reliefs, thereby stopping the proceedings to determine the case and ensure justice prevails.
While staying the proceedings, Justice Alexander Muteti stated that “the judgment scheduled for delivery on October 7, 2026, shall await the ruling of this court in the instant application.”
Despite staying the judgment, Justice Muteti noted the history and urgency of the matter and directed that the ruling be delivered on October 15, 2026,
“Owing to the history and urgency of the matter, the court shall deliver the ruling on.
Sitting in the Magistrate Court in Milimani, Chief Magistrate Dolphina Alego set the date for the judgment after the final submissions by the defence following the closure of the prosecution’s case where the duo were put on their defence.
The conclusion of the matter comes after the myriad applications by the defence in the High Court and in the Magistrate Court seeking various reliefs, including recusal of the trial Magistrate and stopping the proceedings of the matter.
Finally, the High Court pronounced itself and directed the matter to proceed before the trial Magistrate, since it had reached its tail end and the reliefs sought came late.
While directing how the matter would be concluded, Justice Alexander Muteti noted that the duo were found with a case to answer and Chelogoi had already tendered his defence when, through his lawyer Harrison Kinyanjui, he applied for the file to be transferred to another Magistrate, citing that the trial Magistrate transferred to another Division.
Appearing before Justice Alexander Muteti, the DPP, through lawyers Idris Ali, Lorna Miima and Allan Mogere, in their submissions urged the Judge to dismiss the application filed by the former PC Davis Nathan Chelogoi through his lawyer Harrison Kinyanjui, requesting the court to give directions that the matter pending in the lower court be transferred to another Magistrate.
The former PC is charged alongside Andrew Aseli Kirungu, a senior Lands official in the Ministry of Lands, where they were charged with various counts of conspiracy to defraud businessmen Ashok Rupshi Shah and Hitenkumar Raja of a parcel of land valued at Ksh 1.35 billion situated in Lower Kabete.
