Former Kenya Railways Accountant Convicted of Stealing Ksh 45 Million

A former Kenya Railways office accountant has been convicted by a Nairobi court of the offence of stealing Ksh 45 million, the property of the said company.
Kelvin Kakui Muthama was convicted by the Milimani Principal Magistrate Paul Mutai of the offence that occurred on various dates between October 10, 2019 and November 3, 2022, at the company’s head office in Nairobi.
The monies came into his possession by virtue of his employment.
While delivering the judgment, the Magistrate noted that Muthama was an employee in the company holding the position of an office accountant and the money went through his office,
“It is not disputed that the accused was an employee in that company holding the position of an accountant handling the company’s money. I hereby convict the accused under Section 215 of the Criminal Procedure Code,”
The defence lawyer submitted to the Magistrate to extend the bond terms pending sentence, citing that he is not a flight risk,
“Your honour i pray this court to extend the bond terms of the accused pending sentencing, considering he has been attending this court without failure,” the lawyer submitted.
The application by the defence was declined by the court, indicating that Muthama is a convict, not a suspect.
The court will deliver the sentence on October 7, 2026.
