Gospel Artist Ringtone and Another Face Land Fraud Charges
They were claiming adverse possession that they have lived therein for more than two decades a fact they knew to be false.
Popular gospel artist Alex Nyachonga Apoko alias Ringtone has been charged with conspiracy to defraud a parcel of land worth Ksh 50 million.
Apoko was charged alongside Alfred Juma Ayora when the prosecution indicated that, on or before February 28, 2023, at an unknown place within the Republic of Kenya jointly conspired to defraud Teresiah Adhiambo Odhiambo of her land parcel number Nairobi/Block 99/142 measuring approximately 0.1908 hectares valued at Ksh 50 million.
They were claiming adverse possession that they have lived therein for more than two decades a fact they knew to be false.
Separately, Ayora was charged with false swearing contrary to Section 114 of the Penal Code.
The court heard that on February 28, 2023, at Nairobi city within Nairobi county, before S.M Katonya advocates a person authorized to administer oath falsely swore an affidavit upon a matter of public concern to the effect that you have resided in the said parcel of land for two decades a fact he knew to be false.
He was further charged with perjury. The Prosecution told the court that on the aforementioned dates within Nairobi county in judicial proceedings in Environment and Land Court case number E012/2023, Ayora was the petitioner while Teresiah Adhiambo and the Land Chief Registrar were the respondents, in an affidavit sworn before S.M Katonya advocates and commissioner for oaths, filed in the said application knowingly he gave false testimony touching on the said application pending before the said court that he has resided on the said land for two decades a fact which he knew was false.
They appeared before the Milimani principal magistrate Rose Ndombi and denied the charges.
The magistrate ordered the duo to be detained in custody awaiting the production of a pre-bail report on May 19, 2025.
