Kisumu Nurse Charged with Stealing Ksh 40 Million from Afya Sacco
The prosecution did not oppose his release on bond but urged the court to consider the nature of the offence and grant reasonable terms.
A nurse based in Kisumu has been charged at a Nairobi court with stealing Ksh 40 million from Afya Sacco Society Limited.
Appearing before the Milimani Chief Magistrate Lucas Onyina, Kelvin Muhati Amboye denied five counts of conspiracy to defraud, stealing, acquisition, and use of the proceeds of crime.
The prosecution told the court that on diverse dates between April 20, 2021, and January 31, 2025, at Afya Sacco Society Limited (ASSL) in Nairobi CBD, within Nairobi county, jointly with others before the court, with the intent to defraud, conspired to defraud Ksh 40,169,165, the property of the aid (ASSL).
The court heard that they created deposits and withdrawals fraudulently from Front Office Service Activity (FOSA) accounts, falsely pretending that the transactions were genuine, which led to the loss of the aforementioned amount.
In another count, Amboye was charged with the acquisition of proceeds of crime. On May 31, 2021, and August 21, 2024, at (ASSL) jointly with another, before the court acquired Ksh 2,801,616, the property of the said Sacco, which knowingly it formed part of the proceeds of crime deposited in the Fosa account. He was further charged with using the said money.
He denied the charges and pleaded with the court to release him on lenient bond terms.
He told the court that he is not a flight risk and his place of abode is known.
“Your honor, I am a father of three, and I pray this court to grant lenient bond terms,” he said through his lawyer.

In his directions, the Magistrate released the accused on bond of Ksh 4 million with a surety of a similar amount, or alternative cash bail of Ksh 2 million with one contact person.
The matter will be mentioned on January 6, 2026, for pre-trial and direction.
