Legal Battles: Kevin Kang’ethe’s Plea for Access of Debit Cards and Medical Care

The murder fugitive suspect Kevin Kang’ethe has pleaded with the court to be allowed access to his phones and debit cards where he can get cash to facilitate his suit.

Kang’ethe who has been in industrial Area Remand prison told the court via his lawyer John Maina Ndegwa that the denial to access his phone and debit cards has negatively affected him since it is the only way to get cash,

“Your honor it is the only way my client can get money to facilitate the suit and denying him the access has led him to limitation in getting justice,” Said Mr Ndegwa.

He also wanted the court to give orders that his client be allowed to access medication whenever in need since the facility dispensary does not give substantial care and only takes the samples and nothing more is done.

The lawyer urged the court to give orders for Kang’ethe to be taken to Kenyatta National Hospital or any other hospital whenever in need of medical attention.

Mr Ndegwa also holds on to the fact that the court ordered the respondent to be detained at Industrial Area Medium Remand prison and that the order was infringed for being held at the main remand facility.

The lawyer who is now on record representing Kang’ethe pleaded with the court earlier to be given three weeks to go through the file before proceeding to argue on the issue of bond terms which was suspended after he (Kang’ethe) pleaded for time to seek another lawyer.

In the mention of the matter which was conducted virtually, Ndegwa asked the court to intervene to get the typed orders from the prosecution since he is yet to have them,

“Your honor I am requesting for this court to intervene for me to get the typed orders from the prosecution since whenever I request them to serve me they always took me on circles,” pleaded Ndegwa.

He further asked the court to give protection to the suspect’s family which he claimed is continually intimidated and issued with threats hence living with fear.

In response to the issue of medical attention, Magdalene Nduati from the DPP did not object to the plea by the defence for the respondent to be taken to Kenyatta National Hospital or any other hospital for treatment when the need arises,

“We do not oppose the plea by the defence for his client to be taken to Kenyatta National Hospital or any other hospital for treatment when in need,” she said.

On the issue of the typed orders not served to the defence, she told the court that the documents were served to her an hour before she proceeded on the mention of the matter early yesterday.

Kang’ethe was arrested on a warrant issued by a United States of America court with allegations of killing his girlfriend Margaret Mbitu on diverse dates between October 30 and November 4, 2023.

In his brief ruling, Milimani chief magistrate Lucas Onyina directed the relevant documents be served to both parties by Monday.

The magistrate further ordered the DPP to respond to the submissions raised by the defence on the same day.

The matter will be mentioned on Monday, April 8, 2024, to confirm the complying of the given orders.
