Plea-Taking Postponed for Four Suspects in Dr Victoria Mutiso Murder Trial
While postponing the plea, Justice Kanyi Kimondo said that, "the charges against the suspects will not proceed since they are yet to undergo psychiatric examination before pleading."
The High Court has postponed the plea-taking of the quartet alleged to have murdered Dr Victoria Mutiso after the Director of Public Prosecutions (DPP ) Danstan Makori informed the court that the suspects are yet to undergo psychiatric examination.
While postponing the plea, Justice Kanyi Kimondo said that, “the charges against the suspects will not proceed since they are yet to undergo psychiatric examination before pleading.”
Rose Mbithe Mulwa, Chris Mulwa, Angela Mulwa and police constable Elijah Kibelion Kemoi will be remanded in custody until September 23, 2026, when they will plead to the charges.
“The suspects will be remanded in custody as follows: Chris Mulwa and PC Kemoi will be remanded in Nairobi Remand Prison and Mbithe and Angela in Langata Women’s Prison, ” Justice Kimondo said.
The DPP further requested the court to consolidate the two separate files since the charges are similar.
The court directed the suspects to be taken to Mbagathi Hospital or any other government hospital within Nairobi for psychiatric examination before the plea is taken.
According to the court documents, the intended charge read that in the morning of July 29, 2026, at about 0930 hours along Mwensi Road in Kilimani Sub-county within Nairobi County, jointly with others not before court, murdered Dr Victoria Nthunya Mutiso.
The plea will proceed before Justice Muteti on September 23, 2026, for plea-taking and consolidation.
