Two Businessmen Detained Over Alleged Death Threats and Assault at Westlands Club

Two Indian businessmen have been charged in the Kibera law court with the offences of threatening to kill and assault causing bodily harm.
Rahiel Daud and Hitesh Motwani, alias Vicky, who works with Executive Car World, appeared before Kibera Senior Principal Magistrate Zainabu Abdul and denied the two counts presented before them.
The prosecution told the court that on March 25, 2026, at Taal Club in Westlands within Nairobi county, without lawful excuse, threatened to kill Arya Anuj.
In the second count, the court heard that at the aforementioned time, the duo assaulted Arya Anuj, occasioning bodily harm.
They denied the charges and, through their lawyer, requested to be released on lenient bond terms, assuring the court that they would comply with the terms and conditions set by the court.
“Your honour, we pray for the release of the accused persons on lenient cash bail since they are not a flight risk,” the defence pleaded.
The prosecution did not oppose the release of the accused persons on bond but urged the court to consider the seriousness of the first count of threatening to kill. She also urged the court to consider the probation report before granting bond to know the relationship of the duo within the society.
Further, the prosecutor requested the court to issue an order that the accused not leave the jurisdiction of the court.
The duo are also alleged to be involved in a fraud and extortion business.

The defence had earlier applied for the deferment of the plea-taking, citing that the accused persons were forced to record their statements behind a building at Capitol Hill Police Station, and the need for the DPP to review the charges to determine whether they meet the prosecution threshold.
In her directions on the issue, the magistrate stated that before a charge sheet is presented in court, the file from investigators is reviewed and approved by the Office of the DPP, if considered worthwhile for the involved parties to answer to the respective charges.
