Court Defers Plea in Ksh 49 Million Real Estate Fraud Case

"Your honour, my client fell sick yesterday and rushed to the hospital and the doctor prescribed medication and gave him three days of bed rest," the defence lawyer told the magistrate.

The Nairobi court has differed the plea taking of a man charged with obtaining Ksh 49 million in pretence to sell a residential home to a businesswoman.

James Okuyo Okutoyi, the court heard that he was arrested on March 18, 2025, and he was released yesterday, Monday March 23, and he went to seek medication after falling sick,
“Your honour, my client fell sick yesterday and rushed to the hospital and the doctor prescribed medication and gave him three days of bed rest,” the defence lawyer told the magistrate.
The prosecution did not oppose the defence’s application for the plea to be deferred until Tuesday March 30, 2026, when he will be charged.
The prosecutor further applied for the warrant of arrest to the co-accused Eric Ochieng Ouko who failed to appear in court.
According to the court documents, the duo are required to appear in court to answer to 10 counts of obtaining money by pretence, forgery and uttering forged documents.
They are alleged to obtain Ksh 49,381,969, from Esther Mutinda Sigilai by pretending to be in a position to sell to her a residential home in a parcel of land Nairobi/5842/13.
The matter will be mentioned on Tuesday 31, 2026, for plea taking and further direction.
