Milimani Court Releases Man Charged with Possession of Forged USD Notes
"The accused is a Bunge la Mwananchi member, and he is well known in the society. His place of abode is known, and he is willing to comply with the terms to be set by this court," the defence pleaded.
The Nairobi Magistrate’s Court has released a Bunge la Mwananchi member who was charged with being in possession of fake USD notes on bond.
Milimani Senior Principal Magistrate Irene Nyangena released David Muthii Wanjohi on a cash bail of Ksh 150,000, after pleading not guilty to the charge of being in possession of fake banknotes contrary to Section 359 of the Penal Code.
The prosecution told the court that on April 25, 2026, in Kahawa Sukari area within the Republic of Kenya unlawfully was found in possession of five forged USD currency notes of 100 denominations without serial numbers, knowing them to be forged.
The prosecution did not deny the accused’s lease on bond but urged the court to grant the figure that commensurate with the offence.
“Your honour, I do not have instructions to oppose the accused person being released on bail, but I urge this court to grant reasonable terms considering the offence committed,” the prosecutor submitted.
The defence team pleaded with the court to grant a Cash bail of Ksh 10,000, claiming the accused person is not a flight risk.
“The accused is a Bunge la Mwananchi member, and he is well known in the society. His place of abode is known, and he is willing to comply with the terms to be set by this court,” the defence pleaded.
The lawyer also questioned the prosecution on the issue of jurisdiction by informing the court that the accused was arrested at Kahawa Sukari and he was taken to Milimani law court to face charges.
He was released on a cash bail of Ksh 150,000, and the case was scheduled for mention on May 11, 2026, for pre-trial.
