Nigerian Charged in Ksh 60M Fraud Was in Kenya Illegally, Court Told

An immigration officer based at Jomo Kenyatta International Airport (JKIA) has informed the court that one of the two Nigerian fraudsters charged with obtaining Ksh 60.4 million was illegally in the country during the time of the arrest.
While testifying before the Milimani Principal Magistrate Caroline Mugo, Joan Shuvole confirmed that Victor Wagwu, a Nigerian national, was unlawfully in the country when the duo was arrested.
The officer confirmed before the court that the first entry associated with Wagwu was recorded on April 3, 2015, and admitted that by then he was legally in the country.
“The first entry that was recorded by the immigration department against Wagwu was in 2015, where it was confirmed that by then he was legally in the country,” Shuvole told the court.
The principal officer appeared before the court to confirm the immigration status of Ali Ojo and Victor Wagwu, both foreigners from Nigeria who were arrested in the country for the offence of fraud and being in the country illegally.
She confirmed to the court that Ojo was legally present in the country.
They were jointly charged with fraudulently obtaining Ksh 60.4 million from a Kenyan businessman, Noor Omar Ahmed, using fraudulent tricks in the guise of purchasing a reagent to clear stamps on United States Dollars that he was to receive after the alleged sale of the family’s property known as Lisbon Hotel.
They allegedly obtained the said money on various dates between January 20 and May 19, 2023, in the Nairobi Central Business District, jointly with others not before the court.
They were also charged with being unlawfully in Kenya.
The case will proceed to the hearing on September 16, 2026.
