85-Year-Old Nairobi Man Sentenced to Prison or KSh 900,000 Fine for Fraud

John Maina Njoroge was convicted of six counts of conspiracy to defraud, forgery, making false documents, and personation.

A Nairobi court has sentenced an 85-year-old man to serve two years in prison if he fails to pay a fine of KSh 900,000.

While delivering the sentencing, Milimani Senior Principal Magistrate Dolphina Alego indicated that he had been guided by the pre-sentencing report that was brought before the court,

“I have been guided by the report that was produced by the officer investigating this matter and also guided by the law to deliver this sentence,” the magistrate stated.

The Magistrate noted that the accused person had two other separate matters in the same court and another one in Makadara.

John Maina Njoroge was convicted of six counts of conspiracy to defraud, forgery, making false documents, and personation.

He was charged with forging a title deed number Nairobi/Block 110/645, which purported to be a genuine title issued and signed by Irene Jepchumba Mutai, a land registrar based in Nairobi. Jointly with others who were not before the court, they intended to defraud Gibson Hastings Kuhiguka Gitome of the said land measuring 0.5 Hectares, situated in Thome, and valued at Ksh 50 million.

He was charged with making a false sale agreement of the said land and a letter dated January 1, 2017, purported to be a genuine letter signed by Gitome.

He was also charged with making a false identity card in the name of Gibson Hastings Kuhiguka Gitome, purporting it to be a genuine and valid identity card issued by the Director of the National Registration Bureau.

Further, he was charged with personating the said Gitome and that he was in a position to sell the said land parcel to Kennedy Omondi Oketch.

While delivering the sentence, the magistrate indicated that the fine will be consecutive as per the counts, but the sentence will run concurrently.
