Employee Jailed for Role in Theft of Employer’s Ksh 8.8M Mercedes-Benz

"I plead with this court to impose the least severe of the sentences, especially for the first-time offenders," they pleaded.

The Nairobi court has sentenced two accused persons charged with stealing a motor vehicle valued at KSh 8.8 million to serve five years in prison.
The duo, Miriam Adhiambo Amboka and Timothy Omwande, had pleaded to the court in their mitigation that they are remorseful of the offence and sought leniency on the sentence.
Through their lawyer, they indicated that they are first-time offenders and seek mercy since they are solely relied on by their families.
“I plead with this court to impose the least severe of the sentences, especially for the first-time offenders,” they pleaded.
They indicated that the stolen vehicle was fully paid for by the insurance.
The prosecution urged the court to consider the complainant despite being reinstituted by the insurance company since he has not fully recovered emotionally.
They also drew the court to consider that Amboka was entrusted by the complainant by virtue of her employment, but proceeded to commit the offence.
In delivering the sentence, Milimani Chief Magistrate Dolphina Alego considered the mitigation and sentenced Amboka in the first count to four years custodial sentence or pay a fine of one million.
Omwande, in the same count, was sentenced to five years in prison or pay a fine of Ksh 2 million.
In the second count of entering a dwelling place with intentions to commit a felony, Omwande was sentenced to five years in prison.
They  were charged in 2021 with two counts of stealing a motor vehicle and entering a dwelling place with intentions to commit a felony.
In the first hey were charged that on November 23, 2021, at Cunningham estate in Kilimani, within Nairobi County, jointly with others, not before the court, a Mercedes-Benz GLC 220D black in colour, registration KDC 141 L valued at 8.8 million, the property of Dr Thambaiya Carnjini Yogeswaran.
Separately, Omwande was charged with entering a dwelling place with intentions to commit a felony. He entered the Cunningham estate and entered the house of the complainant.
