Nairobi Couple in Court Over Alleged Ksh 12.3 Million Forex Scam

A couple has been charged in the Milimani court with the offence of obtaining Ksh 12.3 million by pretence contrary to the law.
Timothy Iguta Macharia and his wife, Norah Gatugi Micheni, were facing four counts of obtaining money by pretence, acquisition and use of proceeds of crime.
Appearing before Principal Magistrate Paul Mutai, the couple denied the charges and pleaded with the court to be released on lenient bond terms, citing that bond terms are meant to secure the accused’s appearance in court for trial, not to punish.

The lawyer added that the couple have small kids who need their attention despite the mother being sickly, although she wanted to see a doctor regularly.
The couple was charged with, on diverse dates between September 2025 and February 2026, in Nairobi county within the Republic of Kenya, with intent to defraud, jointly obtained Ksh 2.3 million from Stacy Njoroge Kabura by pretending to be in a forex business and would be remitting 10 per cent of the principal amount every month, which was a false fact.
In the second count, the couple was charged with obtaining Ksh 1.5 million from Duncan Kariuki Muya by pretending to invest the money in a forex business that would be earning interest every month.
They were further charged with the acquisition and use of the proceeds of crime, which is contrary to the law.
The prosecution did not oppose their release on bond but urged the court for stringent terms commensurate with the amount on the charge sheet.
In determining the matter, the Magistrate considered the applications by the defence and the prosecution and granted a bond of 2 million or an alternative cash bail of Ksh 300,000, with one contact person each.
The matter will be mentioned on June 8, 2026, for pre-trial.
