Court Orders Accused in Ksh 17M Fraud Case to Appear Physically After Repeated Absences
Kemboi, who has several matters in Milimani Law courts, has been missing to appear during the mention of this particular case for reasons of sickness.
A Nairobi court has ordered an accused person charged with obtaining goods worth 17 million by pretence to appear in court physically.
Milimani senior principal magistrate Benmark Ekhubi ordered Elius Kemboi Korir to appear in court on September 14 this year without fail.
“I give the orders that the accused person appear in court physically on September 14, 2025, without failure,” the magistrate ruled.
Kemboi, who has several matters in Milimani Law courts, has been missing to appear during the mention of this particular case for reasons of sickness.
When the matter came up for hearing today, Kemboi failed to appear in court for reasons that he is suffering from a chronic illness.
His defence lawyer also failed to appear in court due to being unwell.
The magistrate noted that the accused person has been failing to appear before the court physically and has always given reasons when the matter came up for mention.
The prosecution had called five witnesses who were to testify against Kemboi.
Kemboi was charged with obtaining assorted goods valued at 17,110,000 from Kanduyi Investment Limited by pretending that he was in a position to make payments, which was a false statement.
The offence took place on various dates between August 11 and September 12, 2022, in Nairobi County, in the company of others who were not before the court.
In the alternative count, Kemboi was charged with stealing assorted shop goods worth Ksh 17,110,000 from Kanduyi Investment Limited.
The matter will proceed for a hearing on September 14, 2025, when the main complainant will testify.
