Lawyer Accused of Ksh 59 Million Estate Theft Seeks Out-of-Court Settlement
He prayed for two months' adjournment to pave the way for negotiations between him and the complainant.

A city lawyer facing allegations of stealing Ksh 59 million from the estate of a deceased person now seeks to settle the matter out of court.
When the matter came up for plea on Tuesday, Nelson Ndalila-an advocate of the high court failed to appear in court for the second time but submitted through his counsel Tali Tali that the parties are in communication to solve the matter out of court.
He prayed for two months’ adjournment to pave the way for negotiations between him and the complainant.
Tali Tali told the Milimani senior principal magistrate Dolphina Alego that negotiations are in progress to solve the matter out of court and he concurred with the counsel holding a brief for the complainant Jason Oundo who made the same submissions.
Oundo submitted before the court that they had agreed to settle the matter out of court and he prayed the plea to be deferred for two months,
“Your honor, I pray the plea will be deferred for two months to negotiate and solve the matter out of court,” Oundo submitted.
The magistrate admitted the application by the two counsels and deferred the plea for two months until July 7, 2025.
According to the documents seen by our reporter, Ndalila was to face four counts of commissioning of a serious offense to obtain money from the estate of a deceased person, making and uttering false documents, and obtaining registration by pretenses.
The documents indicated that on June 2, 2023, at an unknown place with others not before the court forged a trust deed in the name of Better Life family trust for a financial benefit of Ksh 59 million from the estate of the late David Jonathan Grantham.
He is also accused of uttering a false document to Andrew Kiplimo Muge purporting it to be a genuine trust deed for the properties of the late Grantham.
