Three Charged in Nairobi Court Over Ksh 22.4M KRA Fraud and Fake Degrees

A duo has been charged in a Nairobi court with fraudulently acquiring Ksh 22,438,666 million in public property.
Claire Wambui Mutembei, Lilian Adhiambo Ochieng and Brian Kipkirui Korir appeared before the Milimani Principal Magistrate Paul Mutai and were charged separately with charges of acquisition of public property, forgery, making of false documents and uttering of false documents.
Wambui was charged that on diverse dates between April 8, 2019 and May 14, 2024, at Kenya Revenue Authority in Nairobi fraudulently acquired Ksh 6,976,952 being public property.
In the second count, she was charged with forging and making a degree certificate number 17 1320 in the name of Mutembei Claire Wambui, assuming to be a genuine document conferred by Maseno University. She pretended to have completed a Bachelor of Arts in International Relations and Diplomacy at the said university, which was false.
Further, she was charged with uttering the said document at KRA head offices at Times Tower in Nairobi while knowing it was a forged document.
Adhiambo was separately charged with acquiring Ksh 5,986,601 being public property at KRA on diverse dates between April 22, 2016 and July 4, 2024.
The court also heard that, with intent to defraud, Adhiambo forged a Moi University degree certificate number 08 1466 in the name of Lilian Adhiambo Ochieng, purporting it to be a genuine certificate conferred by the said university upon graduating with a Bachelor of Arts in Communication and Media Technology, Electronic Media option, which was a false fact.
She also uttered the said fake certificate at KRA Head Office at Times Tower in Nairobi, purporting it to be a genuine certificate awarded by the said University.
Kipkirui, whom the defense lawyer alleged to be a student at Kenya School of Law, acquired Ksh 9,475,113 being the public funds, on diverse dates between January 1, 2022 and June 26, 2024 at KRA in Nairobi.
The prosecution told the court that on April 22, 2016, at an unknown place within the Republic of Kenya, he forged a Moi University degree certificate number 34 2033 in the name of Brian Kipkirui Korir, purporting it to be a genuine certificate awarded by the said university upon completing a Bachelor of Law course, which was a false fact.
He was further charged with uttering the said forged certificate at KRA Head Office at Times Towers in Nairobi.
The defence lawyers urged the court to release them on lenient bond terms, citing that they are willing to comply with the rules to be set by the court.
“Your Honour, the duo will comply with directions of this court, considering they have fully complied with the DCI during the investigations without failure,” the defence submitted.
The Magistrate released them on a bond of Ksh 200,000 and alternative cash bail of Ksh 100,000 each.
The case will be mentioned in two weeks for pre-trial.
