MP Aspirant Posing as Senior Counsel Conned Landowner Out of Ksh 1.6 Million, Court Hears

"Since then, the accused refused to answer my calls, and no eviction was conducted despite paying for the work and fulfilling the court's orders," he said.

A witness told the court how he was conned out of Ksh 1.6 million by a Bomachoge Member of Parliament aspirant posing as an advocate of the High Court.

James Njukia Ihura appeared before Milimani senior principal magistrate Benmark Ekhubi to give his testimony on how he was conned into giving the money to evict the squatters who had occupied his land LR 228132/3 in Mavoko, Machakos county.

Ihura stated that he was introduced to Credius Nyamwange Oigara, the accused, by Kenneth Kipkoech,

“I was introduced to the accused by Kipkoech. The accused told me he was a senior counsel specializing in eviction matters,” Ihura told the court.

After the meeting, Ihura hired Oigara to evict the squatters who had occupied his 100-acre piece of land in Mavoko pursuant to the court’s order. Ihura was directed to compensate the two squatters with Ksh 200,000 each, but despite fulfilling the court’s order, they continued to occupy his land.

Oigara took the job to evict them at Ksh 2 million. In two days, Ihura paid Ksh 1.6 million, where they agreed to pay the balance after the eviction. He produced acknowledgement receipts signed by the accused,

“Since then, the accused refused to answer my calls, and no eviction was conducted despite paying for the work and fulfilling the court’s orders,” he said.

Ihura, who trades as Manyota Constructions Ltd, told the court that the squatters still occupy the land, limiting his selling ability.

Oigara was charged that on various dates between April 13 and 15, 2023, in Nairobi County, he conspired to defraud Ihura, who trades as Manyota Investment Limited, by pretending that he was in a position to effect an eviction order issued by Mavoko Law Court regarding case E057/2022, a fact that he knew was false.

He was also charged with obtaining money by pretence contrary to section 313 of the Penal Code and posing as an advocate of the High Court.

The court heard Nyamwange obtained Ksh 1,600,000 from Ihura on diverse dates between April 5 and 15, 2023.

To accomplish his mission, Oigara posed as an advocate of the High Court on April 5, jointly with another who was not in court.

The hearing will resume on October 31, 2025.
