Ksh 5 Billion Land Fraud Case Against Starehe Boys Center Deferred

A Nairobi court has deferred the plea-taking of a duo who conspired to defraud Starehe Boys Center of their land parcel, valued at Ksh 5 billion.

Milimani Principal Magistrate Geoffrey Onsarigo concurred with the plea by the defence lawyer, who requested that the plea-taking be deferred for Geoffrey Gichuhi Gatu and Kanguru Edward Githinji.

This followed after Githinji a 70 years-old senior citizen developed health complications before the plea was taken. When he was called for the charges to be read, he was unable to stand by himself where his lawyer responded by praying for the court to consider his situation,

“Your honor the second accused person is sick and unable to stand. He cannot comprehend on the nature of the offence hence I would urge this court to differ the plea for two weeks for the purpose of seeking medication,” the lawyer stated.

He assured the court that the duo would avail themselves before the court since they had been complying all through during investigations.

In giving direction, the magistrate released them on a personal bond of Ksh 10 million with three contact persons each and scheduled the matter for mention on June 16, 2025, for plea taking.

According to the court documents, the two were to face four counts of obtaining registration by false pretences, forgery, and the uttering of forged documents.

On or before July 27, 2021, at an unknown place within the country, with intent to defraud Starehe Boys Center their land parcel LR No 1870/III/553/IR No 94224 measuring 2.156 hectares located in the Westland area within Nairobi county valued Ksh 5 billion. They pretended to be the owner of the said land which was a false fact.

They were also accused of forging the certificate of title for part of the said parcel of land purporting it to be a genuine certificate issued by the Ministry of Lands at Ardhi House which was a false fact.

On the third count, they were accused of forging a stamp impression of CK Ngetich a land registrar which appeared on the alleged forged title deeds.

They were further accused of uttering a false document to a person employed by the government. On September 20, 2022, at DCI Gigiri, knowingly and fraudulently uttered the forged certificate of title of the said parcel of land to Coprol Mary Ngai purporting it to be a genuine document issued by the Ministry of Lands at Ardhi House in Nairobi, which was a false fact.

They will appear in court on June 16, 2025, to face the charges.
