Court Extends Detention for Police Duo Linked to Imara Daima Killing

Two police officers who are alleged to have shot and killed a man two weeks ago will remain in custody for three more days before they know their fate on whether to be charged with murder.
While seeking the extension order for three days, the lawyer representing the Independent Policing Oversight Authority (IPOA), Kevin Lusweti, indicated that two crucial witnesses intend to record their statements to reinforce the allegations before the file is referred to the Office of the Director of Public Prosecutions (ODPP) for further directions.
“There are two crucial witnesses who are yet to record their statements, and for the fear of their lives, we pray the detention to be extended by three days,” The lawyer submitted.
The defence vehemently opposed the application, citing that the prosecution has failed to complete investigations despite seeking for two weeks. The court noted that, initially, the prosecution had sought 21 days, but the court opted for the suspects to be detained for two weeks.
“I stand with the prosecution since they had sought 21 days to complete the investigations, but the court granted 14 days. Considering the gravity of the alleged offence, I hereby admit the application by IPOA,” the Magistrate said.
She ordered the suspects to be detained at the Capitol Hill Police Station for three more days. She scheduled the matter for mention on January 29, 2026, for further directions.
IPOA through Abdirhaman Jibril, a senior assistant director of investigations of the Authority, was seeking 21 days detention of Sergeant Edwin Mjomba and Administration Police Constable (APC) Patrick Mutunga at the Capitol Hill Police Station for investigations.
The officers are alleged to have fatally shot Shukri Adan Ibrahim Issaka on January 11, 2026, at around 0610 hours near the MCC area within Villa Police Station. They were arrested and placed in custody at Capitol Hill on the same day vide OB No. 30/11/03/2026.
The court heard that the deceased, Festus Mutinda, and Wycliffe Nyakwama were to deliver a Toyota Fielder registration number KDN 266B to one Jojo in Imara Daima, and on the way, they had an accident with a Matatu, where commotion arose between the two drivers.
Wycliffe decided to drive away after the Matatu driver called his colleagues for reinforcement. He parked the vehicle at MCC school, and they decided to walk back to the scene of the accident on foot.
On their way back to the scene, they were stopped by the respondents who ordered them to lie down. As they were lying down, the respondents shot at them, hitting the deceased on the ear, exiting at the back of his head, and he died on the scene.
The post-mortem was conducted on the same day and revealed that the deceased died of the head injuries that were caused by a single gunshot that penetrated the head.
