Kibera Court Orders Probe into Suspect’s ‘Sick Leave’ Before Plea
"Your honor, I doubt the medical documents produced in court and they need to be verified," the officer said.
The Kibera court has directed the officer investigating a malicious damage to property matter against a business woman to verify the authenticity of the medical documents produced as reasons why the suspect could not take a plea.
When the appeared before the magistrate, Luke Muraya expressed his disappointment after realising the suspect Mary Waithira Gikonyo is said to be sick and when she left the police station was in good health,
“I gave instructions to my junior officers to escort Waithira to court later to be informed she did not take a plea for being sick,”Muraya told the magistrate.
Muraya an Officer in Command of crimes at Hardy Police Station also expressed his disappointment after realising today the day which the court directed the plea to be taken she failed to appear.
He abide with the prosecution’s sentiments that he was doubting the medical documents provided and they need to be verified,
“Your honor, I doubt the medical documents produced in court and they need to be verified,” the officer said.
In response, the defence lawyer John Swaka told the court that when the police arrested his client, she was denied police bail and her health complications started after spending the night in a police cell.
He prayed the court to mention the matter in two weeks time but the court denied directing to follow the seven days indicated on the documents.
In giving directions, the magistrate directed the suspect to avail herself in court on November 4, 2025, to take a plea failure to which the warrant to arrest her would be released.
The magistrate also directed the officer investigating the matter to confirm the authenticity of the medical documents and bring the report during the plea taking.
According to court documents Wanjiru is accused that, on March 22, 2025, at Hardy along Kumbe Road within Lang’ata Sub-county jointly with others who were not in court jointly unlawfully and willfully destroyed the main gate, broke doors to the main house, window panes, CCTV cameras all valued at KSh 325,000 the properties of Eric Munene.
The matter will be mentioned on November 4, 2025, for plea taking.
