Man Sentenced to Probation and Bond for Illegally Entering Bunge Towers
The security team failed to understand how the accused accessed the building. After reviewing the CCTV cameras, they found no footage of him from 7:30 AM on July 30.
A Nairobi court has sentenced an accused person who entered Bunge Towers illegally to two years’ non-custodial imprisonment and a personal bond of Ksh 200,000.
While delivering the judgment, Milimani Chief Magistrate Lucas Onyina noted that the accused person, Nelson Kidero, seems to be mentally challenged and needs psychosocial support on his own.
“The accused person seems to have a mental challenge and he needs psychosocial support on his own,” the magistrate said.
The magistrate released him on a personal bond of Ksh 200,000 as long as he did not repeat the offence for two years.
Kidero was arrested on July 30, this year, at Bunge Towers, a restricted area to the public. He failed to explain under what circumstances he arrived there, despite the main entrance being manned 24 hours a day by Administration police and security guards.
During the prosecution’s presentation of the facts, the court heard that a massage therapist on the premises was the one who met Kidero on the 14th floor after reporting for work at 7:00 AM and informed Joseph Mwangi, a security guard.
The security team failed to understand how the accused accessed the building. After reviewing the CCTV cameras, they found no footage of him from 7:30 AM on July 30.
The court was informed that the cameras were not operating for the period.
Kidero had accessed the gym and wore a red vest and shorts in gym attire, which were brought in court as evidence.
When the security team interrogated him, they were not satisfied with his explanations for being there.
The matter was forwarded to the DCI, who arrested and recorded his statement.
When brought to court, he admitted to accessing the building and asked for forgiveness.
The magistrate ordered the accused to be escorted to Mbagathi Hospital for a psychiatric test before the sentence was imposed.
