Three Businessmen Fined and Jailed for Ksh 1.6 Million Cooking Oil Scam

The trio are charged with stealing 400 pieces of Rina cooking oil in 20 litres of jerry cans valued at Sh1,628,000, the property of Mary Waruguru Ngugi.

Three businessmen convicted for stealing Ksh 1.6 million from a merchant under the pretence that they had won a tender to supply cooking oil from a learning institution associated with Nairobi city county have been fined a total of Ksh 950,000 in default and will serve 3 years in prison.

Josephat Mogwambo Nyamwange alias Ben, Evans Mogeni Ondari alias Patrick and Ben Nyabuga Ochoki were sentenced by Milimani senior principal magistrate Benmark Ekhubi for stealing and forgery.

Nyamwange, Ondari, and  Ochoki were convicted of eight counts of stealing, personation, forgery of an award letter, uttering a forged document, and attempted stealing, while two counts were dropped.

The trio are charged with stealing 400 pieces of Rina cooking oil in 20 litres of jerry cans valued at Sh1,628,000, the property of Mary Waruguru Ngugi.

They stole the oil on diverse dates between September 20 and 30,2021.

They are also accused of representing themselves as Nairobi Metropolitan Services (NMS) employees to Waruguru.

The trio was guilty of forging an award letter for supplying 400 pieces of Rina Cooking Oil 20-litre jerry cans to Mount Olive Training Centre Limited.

They pretended NMS had issued the award letter.

Ekhubi said they presented the forged award letter to Waruguru, claiming it emanated from NMS.

Further, the court found them guilty of forging a purchase order No. 2439 dated September 20, 2021.

Waruguru was furnished with the purchase.

On September 30, 2021, the three attempted to steal 250 pieces of Rina cooking oil in 20 litres jerrycans valued at Sh2,146,000 from Waruguru at Pronto Hotel along City Hall Way , Nairobi.

“After analyzing all the evidence I find that the prosecution has proven beyond reasonable doubt a case in all the 10 counts. I convict you accordingly,” ruled Ekhubi.

He ordered all the convicts to be detained at Capitol Hill ahead of sentence on August 7, 2025.

The court cancelled the bonds of the convicts who were handcuffed and escorted to the Capitol Hill Police Station.

They were given 14 days to appeal against the sentence.
