Malicious Damage Case Adjourned After Defence Claims Suspect Fell Sick in Custody
The magistrate directed the suspect to deposit a cash bail of KSh 20,000 with two contact persons.
The Kibera court has adjourned the plea-taking of a woman accused of malicious damage to properties worth KSh 325,000.
The defence lawyers pleaded with the magistrate to defer the plea-taking of Mary Waithira Gikonyo, who they claim is unwell.
“Your honour, we pray to this court to defer the plea taking of the suspect for two weeks, she fell sick while in police custody, and she needs time to seek medical attention,” the lawyer said.
While producing the medical documents, the lawyer told the court that Waithira had been sick in police cells and she could not plead to charges in that condition, hence urging for time for her to recover.
The prosecution did not oppose the prayers sought by the defence to adjourn the matter for two weeks,
“Your honour, we do not oppose the application by the defence seeking adjournment of the plea taking,” the prosecution responded.
The court documents read that, on March 22, 2025, at Hardy along Kumbe Road within Lang’ata Sub-county, jointly with others who were not in court, unlawfully and willfully destroyed the main gate, broke doors to the main house, window panes and CCTV cameras, all valued at KSh 325,000, the properties of Eric Munene.
According to the lawyer, the matter arises as a matrimonial dispute where there is another case in the High Court involving the same subjects.
The magistrate directed the suspect to deposit a cash bail of KSh 20,000 with two contact persons. The plea taking will proceed on October 28, 2025.
